01Eligibility and Accounts
Our services are intended for individuals who are at least 18 years old and have the legal capacity to enter into binding agreements.
You agree to provide accurate, current, and complete information when applying, registering, or purchasing. You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account, subject to applicable law.
We may refuse an application, restrict access, or suspend an account where reasonably necessary to protect the Company, our customers, our community, or our services, or to address suspected fraud, misuse, unlawful conduct, or a material violation of these Terms.
02Our Products and Services
We may offer business education, real estate investment education, brokerage-related frameworks, training, courses, templates, digital products, community access, consulting, and other services.
Offerings may change over time. The specific deliverables, access period, price, and other material terms applicable to a purchase will be those presented at checkout or in the applicable written agreement.
We may update or improve our materials, delivery methods, platforms, and program structure. We will not use this general right to eliminate a material contractual entitlement already purchased without addressing the change as required by applicable law.
We may use third-party platforms to provide some or all of our services. Your use of those platforms may also be subject to their separate terms and policies.
03Applications and Enrollment
Submitting an application, booking a call, joining a waitlist, or requesting information does not guarantee acceptance into a program or the availability of a particular service.
We may evaluate applications based on program fit, readiness, capacity, eligibility, and other relevant criteria. Any admission, deliverables, deadlines, or participation requirements communicated in writing will apply to the relevant offering.
You agree to provide truthful information and participate in good faith. We may suspend or terminate access for material misrepresentation, fraud, abusive conduct, unauthorized sharing of materials, or other material violations of these Terms.
04Pricing and Payment
Prices and payment options will be disclosed before purchase. Unless expressly stated otherwise, prices are in the currency displayed at checkout and exclude taxes that we are legally required to collect.
You authorize us and our payment processors to charge the payment method you provide for the amounts and on the schedule disclosed at checkout.
You are responsible for keeping payment information current and for any applicable bank, processor, or transaction fees disclosed to you before purchase.
We may correct obvious pricing errors before accepting an order. If a payment fails, we may request an updated payment method, suspend access, or take other lawful steps to collect amounts due.
05Installment Plans
If you select an installment plan, you agree to pay the full purchase price according to the payment schedule disclosed at checkout or in your purchase agreement.
An installment plan is a payment arrangement for the purchased offering, not a month-to-month subscription, unless the applicable checkout terms expressly state otherwise.
Failure to use the service, attend sessions, complete assignments, or achieve a desired result does not by itself cancel your obligation to pay the agreed purchase price.
To the extent permitted by law, we may suspend access for missed payments and pursue lawful remedies for unpaid amounts. We will not charge undisclosed fees or use collection practices prohibited by applicable law.
06Subscriptions and Recurring Payments
Certain services, including optional community access, may be offered on a recurring subscription basis.
Before you enroll in a subscription, we will disclose the applicable price, billing frequency, and material cancellation terms. By affirmatively enrolling, you authorize recurring charges until you cancel.
Where a program includes an initial access period, any continuation as a paid subscription will require affirmative enrollment unless the checkout disclosure clearly provides otherwise and the arrangement is lawful.
You may cancel a subscription using the cancellation method disclosed at enrollment or by contacting [email protected]. Cancellation stops future renewals after the applicable billing period, subject to the disclosed terms and applicable law. Unless required by law or expressly stated otherwise, cancellation does not automatically refund charges already paid or eliminate payment obligations for a separate installment purchase.
We will provide any renewal notices, reminders, cancellation options, or other disclosures required by applicable law.
07Refunds and Cancellations
Except where required by law, or where a written offer, guarantee, or purchase agreement expressly provides otherwise, purchases are nonrefundable once payment is made.
This policy applies to digital products, courses, templates, program materials, community access, and services, subject to any different terms disclosed before purchase.
A refund policy does not waive any non-waivable consumer rights. Where an applicable written guarantee provides a refund, that guarantee will control for the purchase and circumstances it expressly covers.
To request a refund under an applicable guarantee or written refund policy, contact [email protected] and provide the information reasonably needed to evaluate the request.
0890-Day First Deal Guarantee
The 90-Day First Deal Guarantee applies only to customers who purchase a specific Beyond Commissions™ program that expressly includes this guarantee. It does not apply automatically to every Company product, service, course, or community membership.
8.1Our Commitment
Follow the plan, do the work, make the offers, and we will stand behind the process.
If you complete the required implementation steps, actively work your approved acquisition strategy, maintain the required deal activity, participate in the Deal Desk, submit at least 10 qualified offers, complete the required follow-up, and maintain a legitimate funding path for the deals you pursue, but do not obtain a qualifying investment deal under contract within 90 days, we will continue working with you through the program's applicable support channels until you obtain a qualifying deal under contract, subject to the requirements and limitations in this section.
This guarantee is a commitment to continued support, not a refund, reimbursement, or promise of a particular financial outcome.
8.2Start of the Guarantee Period
The 90-day period begins on the customer's program enrollment date, unless the written offer presented at purchase specifies a different start date.
The customer must complete the applicable requirements during the 90-day period to qualify for continued support under this guarantee.
8.3Required Implementation
To qualify for continued support, the customer must:
- Complete onboarding and the Investment Readiness Assessment within 7 days of enrollment.
- Complete strategy selection, a defined buy box, and a funding plan within the first 14 days.
- Complete at least five qualified deal analyses per week during the 90-day period.
- Participate in at least 80% of required Deal Desk and implementation sessions.
- Submit at least 10 qualified offers during the 90-day period.
- Complete required follow-up on active opportunities.
- Take action on qualified opportunities provided through the program when they fit the customer's approved criteria.
- Maintain the required weekly accountability tracker and complete assigned action items.
- Maintain a viable, documented funding path appropriate to the chosen strategy.
- Remain within the approved market, strategy, and acquisition criteria unless a change is approved.
Where a requirement is affected by the Company's cancellation, unavailability, or failure to provide a required program resource, the requirement will be assessed reasonably and consistently with the purpose of the guarantee.
8.4Qualified Deal Analysis
A “qualified deal analysis” means a substantive evaluation of a real estate investment opportunity using the program's required analysis process, including the information and calculations reasonably necessary to assess whether the opportunity fits the customer's approved strategy and buy box.
An incomplete worksheet, duplicate submission, or property that has not been substantively evaluated does not count.
8.5Qualified Offer
A “qualified offer” means a written offer submitted to a seller or authorized representative for a property that reasonably fits the customer's approved acquisition criteria and chosen strategy, supported by the program's required deal evaluation and a reasonable funding plan.
An offer counts when submitted, whether accepted or rejected. An informal expression of interest, an unsubmitted draft, or an offer for a property that does not reasonably fit the approved criteria does not count.
8.6Qualifying Deal Under Contract
A “qualifying deal” means a real estate investment opportunity for which the customer obtains a fully executed, legally binding written purchase agreement, wholesale agreement, or other enforceable agreement placing the customer under contract for the property transaction, subject to the agreement's terms and applicable contingencies.
A verbal agreement, an offer that has not been accepted and executed, or an opportunity still under negotiation does not qualify.
The guarantee milestone is obtaining a qualifying deal under contract, not closing the transaction. Once a qualifying agreement is fully executed within the 90-day period, the milestone is met, even if the transaction later fails to close because of financing, inspections, due diligence, seller conduct, contingencies, or other events.
If no qualifying deal is under contract by the end of the 90-day period, a customer who has satisfied the guarantee requirements becomes eligible for continued program support under Section 8.7.
8.7Continued Support
A customer who satisfies the requirements of this guarantee but has not obtained a qualifying deal under contract within 90 days may continue receiving the applicable program support until obtaining a qualifying deal under contract.
Continued support will be provided through the program's established support channels, which may include the Deal Desk, implementation guidance, feedback on deal analyses and offers, and accountability support, as applicable to the purchased program.
The customer must continue to participate actively, follow the approved strategy, complete assigned implementation activities, submit qualified opportunities for review, maintain the required deal activity and funding plan, and respond to reasonable requests for information.
Continued support is limited to the support and services included in the original eligible program. It does not include additional products, third-party services, property costs, transaction expenses, financing, or other services that were not included in the original purchase.
The guarantee does not promise that a seller will accept an offer, that financing will be approved, that a transaction will close, or that the customer will earn a profit or achieve a particular return.
8.8Verification and Administration
To establish eligibility, the customer must provide reasonable documentation of compliance with the requirements, including deal analyses, submitted offers, participation records, follow-up activity, accountability records, funding documentation, and other reasonably relevant evidence.
The Company may request additional information reasonably necessary to verify eligibility. The customer must respond within a reasonable period specified in the request.
The Company will assess eligibility in good faith against the written requirements of this guarantee and communicate its determination to the customer.
8.9Scope and Limitations
This guarantee applies only to the specific program purchased and only where it was expressly included in the offer. It does not automatically apply to standalone digital products, templates, courses, community memberships, or other services.
The guarantee provides continued program support, not a refund, cash payment, reimbursement, or credit. It does not cover expenses incurred by the customer, including property deposits, transaction costs, professional fees, travel, or financing expenses.
The guarantee does not guarantee a closed transaction, financing approval, income, profit, return on investment, or freedom from loss.
Nothing in this section limits any rights that cannot lawfully be limited or waived under applicable law.
09Educational Information and No Financial or Legal Advice
Our educational materials and services are provided for general informational and educational purposes. They are not individualized legal, tax, accounting, lending, securities, or investment advice.
Real estate transactions involve financial risk. Results depend on factors including market conditions, property characteristics, financing, capital, negotiation, experience, execution, and other circumstances outside our control.
You are responsible for independently evaluating opportunities and obtaining advice from qualified legal, tax, accounting, lending, real estate, and other professionals where appropriate.
You should not rely solely on our materials, estimates, examples, or opinions when making a financial or investment decision.
10No Guarantee of Results
Except for an express written guarantee that specifically applies to your purchase, we do not guarantee any particular business, brokerage, investment, income, revenue, transaction, or financial result.
Testimonials, case studies, examples, and illustrations describe particular experiences or scenarios and are not assurances that you will obtain similar results. Results vary based on individual circumstances and implementation.
You are responsible for your own decisions, actions, business operations, and investments.
11Intellectual Property
The Company and its licensors retain all rights in our names, trademarks, logos, frameworks, methods, course materials, templates, videos, written content, graphics, training materials, community materials, software, and other intellectual property, except for rights expressly granted to you.
Subject to your compliance with these Terms and the applicable purchase terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use purchased materials for your own personal or internal business use during the applicable access period.
Unless we expressly authorize it in writing, you may not:
- Copy, reproduce, distribute, publish, sell, sublicense, or commercially exploit our materials.
- Share login credentials or provide unauthorized access to another person.
- Resell, give away, or redistribute templates, courses, frameworks, or other resources.
- Record, reproduce, or distribute paid sessions or community content without authorization.
- Remove copyright, trademark, or proprietary notices.
- Reverse engineer, misuse, or create unauthorized derivative products from our materials.
- Use our intellectual property to create or market a competing product in violation of applicable law or these Terms.
Nothing in these Terms transfers ownership of Company intellectual property to you. Unauthorized use may result in termination of access and other lawful remedies.
12User Content and Feedback
You retain ownership of content you independently own and submit, subject to rights you grant under this section.
By submitting content to a Company-managed community, program, or platform, you grant us a nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, and use that content as reasonably necessary to operate, administer, and improve the relevant service.
We will not treat this limited operational license as permission to publicly use your name, likeness, testimonial, or identifiable business results in marketing where separate authorization is required by law.
If you provide suggestions or feedback, we may use them to improve our services without compensation, provided we do not disclose your confidential information in violation of our obligations.
You are responsible for ensuring that content you submit does not unlawfully infringe another person’s rights or violate applicable law.
13Community Conduct and Confidentiality
You agree to participate respectfully and lawfully in Company-managed communities and programs.
You may not harass, threaten, impersonate, defraud, unlawfully solicit, or materially disrupt other participants. You may not post unlawful content, share another person’s private information without authorization, or misuse community access to distribute spam or unauthorized promotions.
Participants may share confidential business information in private program settings. You agree not to disclose another participant’s confidential information, personal information, or nonpublic business materials without permission, except as required by law.
We cannot guarantee that other participants will maintain confidentiality or that information shared in a community will remain private. You should exercise discretion before posting sensitive information.
We may remove content or restrict participation when reasonably necessary to protect the community or enforce these Terms, subject to applicable law and any specific contractual commitments.
14Third-Party Services
Our services may rely on third-party platforms, including GoHighLevel, Stripe, Skool, Zoom, Google, Meta, and other providers.
Third-party services may have separate terms, privacy policies, fees, availability limits, or technical requirements. We do not control independent third-party platforms and are not responsible for their acts or omissions, except as required by law or where we have expressly undertaken responsibility.
A third-party outage or change may affect service delivery. We will make reasonable efforts to address material service disruptions within our control.
15Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE, MATERIALS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, EXCEPT TO THE EXTENT A WRITTEN AGREEMENT EXPRESSLY PROVIDES OTHERWISE.
WE DISCLAIM IMPLIED WARRANTIES TO THE EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT OUR WEBSITE OR SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT EVERY DEFECT WILL BE CORRECTED.
NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.
16Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST OPPORTUNITIES, LOST DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OF OUR WEBSITE OR SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE COMPANY AND THE PERSONS IDENTIFIED ABOVE FOR CLAIMS ARISING OUT OF OR RELATING TO A PARTICULAR PRODUCT OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO THE COMPANY FOR THAT PRODUCT OR SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ASSERTED AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE, TO THE EXTENT PERMITTED BY LAW.
THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING ANY LIABILITY THAT APPLICABLE LAW PROHIBITS US FROM DISCLAIMING.
17Indemnification
To the extent permitted by applicable law, you agree to be responsible for third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful conduct, your material violation of these Terms, your infringement of another person’s rights, or your misuse of our services.
This provision does not require you to indemnify the Company for the Company’s own negligence, willful misconduct, or other conduct to the extent such indemnification is prohibited by law.
We will provide notice of a covered claim where reasonably practicable. The handling and resolution of a claim will remain subject to applicable law.
18Suspension and Termination
We may suspend or terminate access where reasonably necessary to address nonpayment, fraud, unlawful conduct, security risks, unauthorized distribution of materials, material violations of these Terms, or other substantial threats to the Company or its users.
Where appropriate, we may provide notice and a reasonable opportunity to remedy a violation. We may act without advance notice where necessary to protect security, comply with law, or prevent ongoing harm.
Termination does not automatically eliminate payment obligations already incurred, and provisions that by their nature should survive termination will continue to apply, including provisions concerning payment obligations, intellectual property, confidentiality, disclaimers, liability, and dispute resolution.
Any refund rights expressly provided by a written guarantee or applicable law remain subject to their terms.
19Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except where applicable law requires another law to apply.
The parties will first attempt in good faith to resolve a dispute informally by providing written notice describing the dispute and the requested resolution to the contact address above.
If the dispute cannot be resolved informally, it may be brought in a court of competent jurisdiction, subject to applicable law. You and the Company consent to personal jurisdiction and venue in the state or federal courts located in Wyoming to the extent that consent is enforceable and no mandatory law requires otherwise.
Nothing in this section prevents either party from seeking urgent injunctive relief where legally available or limits rights that cannot be waived under applicable law.
20Changes to These Terms
We may update these Terms to reflect changes to our services, business practices, or legal requirements. Updated Terms will be posted on our website with a revised “Last Updated” date.
Changes will apply prospectively unless applicable law permits otherwise. Where required, we will provide notice or obtain acceptance. A material change will not retroactively remove a right expressly granted under a prior written purchase agreement.
Your continued use of the website after an update constitutes acceptance only to the extent permitted by applicable law. Where affirmative acceptance is required, we will obtain it.
21General Provisions
If any provision of these Terms is found unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain in effect to the extent permitted by law.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
You may not assign your rights or obligations under these Terms without our written consent, except where applicable law provides otherwise. We may assign these Terms in connection with a merger, restructuring, or sale of all or substantially all relevant business assets, subject to applicable law.
These Terms, together with the applicable checkout disclosures, written offer terms, and any incorporated agreement, constitute the agreement governing your use of the relevant service. If a specific written agreement conflicts with these Terms, the specific agreement controls for the subject matter of that conflict.
Nothing in these Terms creates a partnership, joint venture, employment relationship, fiduciary relationship, or agency relationship between you and the Company.
